What are the Holder’s rights?

1.  Confirm the existence of treatment and obtain information about it;

2.  Access the data;

3.  Correct incomplete, inaccurate or outdated data;

4.  Ask for the anonymization, blocking or deletion of unnecessary, excessive or treated data in violation of local legislation;

5.  Porting the data to another service or product provider, safeguarding the company’s commercial and industrial secrets;

6.  Delete Personal Data processed with the consent of the holder;

7.  Obtain information from public and private entities with which the company shared data use;

8.  Be informed about the possibility of not providing consent and about the consequences of denial; and

9.  Revoke consent.

Note: the user acknowledges being aware that, even in the event of an exclusion request, Multicare will observe the minimum information storage period determined by Brazilian legislation.

With whom or in what situations will Multicare be able to share user Personal Data?

1.  When necessary for Multicare’s operational activities;

2.  By court order, arbitration or by the request of administrative authorities;

3.  With service providers or partners to manage or support certain aspects of our business operations on our behalf, such as hosting and data storage service providers, fraud management, sales on our behalf, order fulfillment, content personalization , advertising and marketing activities (including digital and personalized advertising) and IT services.

Security Measures

User information will be stored by Multicare in its own servers or in those of third parties contracted by it, always protected by confidentiality agreements and following all security measures required by law.

Multicare uses its best efforts to protect user information. However, due to the nature of the Internet itself, there is no way to ensure that unauthorized third parties do not succeed in improperly accessing stored information.

Confidentiality of collected Personal Data All the collected information is considered confidential and will be treated and stored in accordance with the provisions of this Policy and with the proper adoption of adequate security measures.

 

1. DEFINITIONS

1.1   The terms contained in this Privacy Policy, whenever used with the first letter in capital letters, will have the meaning established below, whether in the plural or singular:

I. Multicare: is Multicare Pharmaceuticals LTDA, registered with the CNPJ/ME under nº 24.331.585/0001-90, a legal entity governed by private law, headquartered at R. Gomes de Carvalho, 1666, cj. 151, 15th floor, Vila Olímpia – SP

II. To Accept or Accept: means the act of the Holder clicking on the box “I agree with the Privacy Policy”. Such act implies the free, informed and unequivocal expression by which the Holder agrees with all the provisions of such documents.

III. Holder: means a natural person to whom the Personal Data belongs.

IV. Personal Data: means information that allows the identification, directly or indirectly, of natural persons.

V. Sensitive Personal Data: means Personal Data about racial or ethnic origin, religious conviction, political opinion, membership of a trade union or religious organization, philosophical or political nature, data relating to health or sex life, genetic or biometric data, when linked to a natural person.

VI. Processing of Personal Data: means any operation carried out with Personal Data, such as collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication, transfer, diffusion or extraction;

VII. Data Protection Laws: means all legislation applicable to the Processing of Personal Data, according to the territorial scope, which include, but are not limited to: Law No. 13.709/2018 (General Data Protection Law – Brazil); Regulation 2016/679 (General Data Protection Regulation – European Union); and further US territorial laws.

VIII. Term of Free and Informed Consent: document in which the free and informed consent of the participant and/or his/her legal guardian is made explicit, in writing, about the research in which you propose to participate.

2. PURPOSE

2.1   Multicare values ​​and recognizes the importance of your privacy. Therefore, we have created this Privacy Policy in order to clearly inform you about the Processing of your Personal Data and demonstrate our commitment to the protection of your privacy and your Personal Data.

2.2   You are not obligated to share the Personal Data we request. However, if you choose not to share them, in some cases we may not be able to fulfill the purposes described in this document.

3. COLLECTION OF PERSONAL DATA

3.1   Multicare may collect Personal Data and Sensitive Personal Data when you access our website or contact us by any means of communication, as described below:

4. DATA SHARING

4.1   Multicare always protects the identity of the Holders, using data protection mechanisms provided for in technical and organizational standards, as well as the measures provided for by law.

4.2   Personal Data and Sensitive Personal Data obtained for the purpose of clinical studies and research will be available for consultation by researchers and sponsors at the research stages and during post-study.

4.3   By court order, arbitration or by request of administrative authorities.

4.4   Multicare may share data with service providers or partners to manage or support certain aspects of our business operations. These providers may include: hosting and data storage service providers, fraud management, sales on our behalf, order fulfillment, content personalization, advertising and marketing activities (including digital and personalized advertising), and IT services.

4.5   Multicare reserves the right to share data with third parties, in the event of any reorganization, merger, sale, joint venture, assignment, transmission or transfer of all or part of our company, assets or capital (including those relating to bankruptcy or similar).

4.6   Data sharing with third parties may occur when it is essential and inherent to the purposes already described.

5. INTERNATIONAL DATA TRANSFERS

5.1   International data transfer may occur to other Multicare units located abroad.

5.2   Multicare commits to share data securely to countries whose Personal Data protection legislation is compatible with local legislation or in accordance with the responsible regulatory body.

6. USER RIGHTS

6.1   You may, at any time, request from Multicare: (i) confirmation that your Personal Data is being processed; (ii) access to your Personal Data; (iii) corrections to incomplete, inaccurate or outdated data; (iv) anonymization, blocking or deletion of unnecessary, excessive data or data treated in violation of the provisions of the law; (v) portability of Personal Data to another service provider, contact that this does not affect our industrial and commercial secrets; (vi) erasure of Personal Data processed with your consent, to the extent permitted by law; (vii) information about the entities to which your Personal Data have been shared; (viii) information about the possibility of withholding consent and the consequences of withholding consent; and (ix) revocation of consent. Your requests will be handled with special care so that we can ensure the effectiveness of your rights. You may be asked to provide proof of your identity in order to ensure that only the data subject exercises his or her rights over your Personal Data.

6.2   You should be aware that in certain cases (for example, due to legal requirements), your order may not be immediately satisfied, and Multicare may not be able to fulfill it due to compliance with legal obligations.

7. SECURITY OF PERSONAL DATA

7.1   We seek to adopt the technical and organizational measures provided for by the Data Protection Laws suitable for the protection of your Personal Data in our organization.

7.2   No data transmission or storage system is guaranteed to be 100% secure. In any case, we always seek to prevent leaks from occurring by adopting a high level of protection in our systems, carrying out all the necessary safety tests.

7.3   If you have any reasons to believe that your interaction with us is no longer secure (for example, if you believe that the security of your data has been compromised), please inform us immediately.

8. CHANGES TO THIS PRIVACY POLICY

8.1.  Multicare is guaranteed the right to change the Privacy Policy at any time, without prior notice to the Holders, so it is the Holder’s duty to keep an eye out for possible updates of these documents, which will be immediately available on the channels usually used by Multicare, and the modifications will take effect on the date of publication of the new version of the Privacy Policy. If there is a change related to (i) the specific purpose of processing Personal Data; (ii) the form and duration of the processing of Personal Data, observing Multicare’s commercial and industrial secrets; (iii) the identification of the controller of the Personal Data; and/or (iv) the information about the shared use of Personal Data by the controller and the purpose, we will inform the User in a prominent way, either through the contact information that we have in our database or through a notification on the Site and Intranet.

8.2.  We remind you that Multicare is committed not to process your Personal Data in a way that is incompatible with the purposes described above, unless otherwise required by law or court order.
